Success Story: Case Dismissed – Twice

Plaintiffs – builders and owners of a “Street of Dreams” home – discovered subterranean landslide damage on their property, which negated a prospective sale. Seeking retribution anywhere they could find it, Plaintiffs filed a lawsuit for $500,000 against eight separate defendants, including Clients – two brothers and their limited-liability company, whose sole connection to the property was that they had owned it at one point in time. However, they sold the property some five years before the lawsuit was filed to a developer without subdividing, developing or improving it in any way. David W. Owens was twice successful in dismissing the suit, the second time with prejudice, preventing Plaintiffs from bringing the same suit against Clients again.
